RTA Modification Notice Update
Updated April 2021: The period of Public Health Emergency Declaration has been extended to 21 June 2021. The Modification Notice of 60 days (extended from 14 days), remains in place.
Extension of Public Health Emergency Declaration
On 10th March 2021, the Health Minister (Natasha Fyles) extended the period of Public Health Emergency Declaration by a further 90 days to 21 June 2021, as published in the Gazette.
The Modification Notice in the Residential Tenancies Act 1999 is only valid during a period where the Public Health Emergency Declaration is in place.
The REINT has advised us that the Modification Notice remains in place to align with the Declaration of Public Health Emergency.
We would like to highlight the notice periods currently in place, which have been extended to 60 days (from 14 days).
The Modification Notice includes notice imformation - whereby if the 60 day window for notice is missed, 60 days notice has to be given from the date of EXPIRY, potentially making it 120 days notice to vacate.
